Purpose

To provide the process for extending the nominal term of a registered training contract.​​

Overview

This procedure outlines how to apply for an extension to the nominal term of a registered training contract when the current nominal term ends before the apprentice/trainee completes the requirements of the training plan for the apprenticeship/traineeship.

Responsibilities

​Employer:
  • if an employer decides that the training required under the training plan cannot be completed within the nominal term, they must notify the Australian Apprenticeship Support Network (AASN) provider or the Queensland Department of Education and Training (DET, Qld), in writing, of this event within 14 days.

Employer, apprentice/trainee and supervising registered training organisation (SRTO):

  • review the training plan and, if all training and assessment cannot be completed by the nominal completion date, agree to apply to extend the nominal term
  • agree on a date by which all training will be completed
  • apply to extend the nominal term before the current nominal term ends
  • monitor progress against the training plan.
Delegated officer:
  • decide to approve, or not approve, applications to extend the nominal term

AASN provider:

  • send details to DET, Qld in the agreed format noting approved or not approved (reasons for not approving to be provided).

Process

Employer, apprentice/trainee and supervising registered training organisation (SRTO):

  • review the training plan and, if it is apparent that all training and assessment cannot be completed by the nominal completion date of the apprenticeship/traineeship, agree on a date by which it will be completed
  • apply to the AASN provider or DET, Qld in the approved form (Extension of nominal term of registered training contract - ATF–014) before the current nominal term ends
    Note: The employer is required to notify the AASN provider or DET, Qld within 14 days after deciding that all training cannot be completed within the nominal term
  • if an extension is approved, monitor progress against the reviewed training plan to ensure all training and assessment is completed by the new nominal completion date
  • if an extension is not approved, the nominal completion date will remain the same
  • if the parties agree to change the training plan, sign the changed training plan within 14 days after agreeing to the change.

Delegated officer:
In deciding to approve or not approve an extension, consider:

  • has the application been received in the approved form?
  • whether the training contract is active or expired (an extension for an expired contract can be approved only if the delegated officer is satisfied that training and/or employment has continued in the period after the expiry date)
  • the reasons provided on the application
  • if the training contract will be completed in the nominated time.

DET, Qld:

  • if approved, update the DELTA record and send DELTA/CAS letters. The SRTO is notified electronically through Training Downloads
  • If not approved, note the decision and reasons in DELTA and send CRM letters.

​Australian Apprenticeship Support Network (AASN) provider – AASN providers, also known as Apprenticeship Network providers, are contracted by the Australian Government and have a Deed of Agreement with the Queensland Department of Education and Training (DET, Qld) to provide targeted services which deliver tailored advice and support to employers, apprentices and trainees. The AASN provider is the first point of contact for the administration of all training contracts.

Approved form – a form approved by the chief executive

Delegated officer – an appropriately qualified person to whom the chief executive has delegated functions and powers
 
DELTA – Direct Entry Level Training Administration, DET, Qld’s database of registered apprentices and trainees (for internal access only)

Nominal term – the time taken by the majority of apprentices and trainees to complete the training required for an apprenticeship or traineeship
 
Supervising Registered Training Organisation (SRTO) – is a Registered Training Organisation that:
1. accepts a nomination to deliver training and assessment to apprentices or trainees as negotiated and agreed under individual training plans
2. assesses whether the apprentice or trainee has completed the training and assessment required to be completed under a training plan
3. when satisfied the apprentice or trainee has completed the training and assessment required, issues the qualification or statement of attainment stated in the training plan, and is a signatory on a completion agreement verifying that all training and assessment required under the training plan has been completed by the apprentice or trainee.
